Day after day and month after month it has published in large letters its rec- ords of ‘‘great strikes,” marvellous rich- ness, etc., etc. People have been misled all over the continent into investing and steered into the snares set by bunco mine operators through this un- principled sheet until the interests of the whole camp are imperilled and an unspeakable stench has arisen extend- ing over the whole country with which unfortunately the name of Rossland, thanks tothe Miner newspaper, is mixed up. Unfortunate investors cry aloud for informetion as to the rich strikes so of- ten reported and are looking to Rossland forareturn. Let them in future kee copies of the paper on the faith o ich they invested and louk to the Ros<- Jand Miner Co.,tlimited, for their money and interest. Under such circumstances itis nota matter of wonder that the company owned chiefly by D. C. Corbin should be made use of to bolster up his falling cause so as to cover up the legal blunders that have been made with reference to the land grant he claims as his, but which be nor his railroad ever had or can have any claim or title to in law. For this purpose the vials of abuse has been poured forth by. this unprincipled sheet on all those who huid a different view and the Proceedings in working the railway. There is no power in the act in- corporating the company to apply the funds of the company except for the of tructing and i it. It is therefore ultra vires of the company, cither to take lands not re- quired for the purposes of the under- taki r to pay money in surveying or | g acquiring them as follows: 1. That in 1802 when the subsidy act was passed the company were not legal- | ¢ ly capable of acquiring and hoiding the lands referred to in the act, nor of ex- pending money in performing the cun- ditions mentioned in the act as prece- dent to such acquirement. 3. The law presumes that the legis!a- ture knew the legal constructige: of both acts and the well known rules and legal constiuctions provide that both acts shall be construed in faver of the public | P' and against the promoters ot those | P! benvficially interested. 4. The subsidy act is practically a contract with the railway company, & corporation which in Izw’ has no cxist- ence so faras the purposes of the sub- sidy act are cone: ‘The sepsidy act is therefore ultra vires void and of no chee except as evidence of intention of 2. half, plimented which their case was briefly that the interests involved were so enormous and the effect of the decis- jon-co far reaching that he did not think it would be right for a single judge on title of the company to was involved. are can appeal to the full court. ‘The judge, in summing up, com- efendants for the manner in presented and said uit to attemp‘ todecide them.
