(b) Where the words the ‘Board” pr the “Commiesioners” or the ‘Board of Licensing Commissioners” occur in this by-law they shall be construed to mean and include the Board of Licensing membrance of the fire company for their prompt and efficient work in preventing the fire yesterday morning spreading over the business portion of the town. —_—_——— It is not an uncommon thing for horses to be ridden through’ the streets of Rossland at a speed that endangers the lives of pedestrians. The city coun- cil should prohibit reckless riding and driving upon the public streets and in- clude a clause requiring all teams to be hitched when left by the driver. Bradstreet’s Statement of the Condition of Trade—Number of Failures. The Board of Licensing Commis- sioners of the City of Rossland may direct the issue of license written or printed or partly written and partly printed which may be in the form con- tained in Schedule ‘‘A” to this by-law and to be signed by the Chairman or acting Chairman of the Board und the sale of which a license is required to be consumed within his shop or with- in the building of which his shop forms a part or which communicates by any entrance with such shop, either: by the purchaser thereof or by any other per- son not usually resident within @uch building and the shop in which he sells iquor shall be open to the street so that any passer by can readily see the whole of the premises therein, either through the window or door. Bt No wholesale license shall be granted to any person who carries on a retail business of any kind on the prem- ises for which a license is sought. 16, Every license issued shall be in force from the date of its issue until and inclusive of the 15th day of July or the 15th day of January whichever shall first happen after the date of the issue there- of unless in the meantime revoked, cancelled or suspended by the License Commissioners who shall have power to revoke, cancel or suspend the same. 17. No license shall be_issued until the applicant has first paid the license fees prescribed as payal le in the sched- ule marked ‘‘B” to this by-law, for li- censes for the-sale of liquors. 18. No person shall sell or offer for sale, intoxicating liquors of any kind within the limits of the City of Rossland with- ‘out having first obtained a_ license authorizing him to do so under this by- law, but this section shall not apply to sales under legal process or for distress or sale by assignees of insolvent debtors or to sales made under licenses lawfully issued under the provisions of ‘An Act Relating to Licenses,” Chapter 73, Vol. 1, of the “Consolidated Acts of 1888” and now existing. 19. No person having a license to sell by wholesale shall allow auy liquor sold by him or in his possession for sale and for the sale or disposal of which such license is required, to be consumed with- in his warehouse or shop within any building which forms part of or is ap- purtenant to ur which sommenicates By a sho same, and every ho! eeper who refuses to supply meals to any person demand- ing the same shall be guilty of an offense under this by-law. No retail or bottle license or re- newal shall be granted to any premises where any kind of goals, wares or mer- chandise are sold excepting tobacco in any form or articles to be used in con- nection with the consumption of to- bacco. lic en shop, warehouse or other place wherein refreshments or Nquors are sold or repatel to ba sold, whether under licsns2 or not and may search every part thereof and of the premises connected therewith, as he thinks necessary forthe purpose afore- said, and every person who is therein and who refuses or fails to admit such officer, policeman or constable or in- spector demanding to enter in pursu- ance of this section in the execution of his duty, or who obstracts or attempts to obstract, the entry of such offer, hi i or ble, on any euch search as aforesaid, shall be subject to the penalties of this by-law. 2), No license shall be granted to any applicant vnder this by-law who is not of the full age of 21 years. 30. Every person licensed under this by-law who permits drankeness or an! violent, quartolsom; riotous or disord- erly conduct to take place on his prein- ises or who sells or delivers intoxicating liquors to any drunken person or per- mitts any drunken person to consume intoxicating liqaor on his premises, or permits persons of notoriously bad char- acter to assembie or meet on his prem ises, or permits any gambling or any unlawful game to be played or carried on on his premises, shall incur a penalty not exceeding $50, with costs of prosecu- tion. 31. Every person who makes or uses, or allows to be made or used an internal communication between licensed. pre! ises and any unli i i which y-law. All convictions obtained under this by-law against persons holding licenses shall be endorsed by the convicting Magis- trates on the back of said licenses and. any license or renewal license issued under this bylaw shall become absolutely forefeited whenever three convictions under this by-law shall have been obtained and endorsed on the back,of any license certificate is- sued in accordance with the terms of this by-law. Allinformations or com- plaints for the prosecution of any offense against any of the provisions of this by- law shall be laid or made in writing within thirty days after the commission of the offense. 38. Foranyand every violation of section 18 of this by-law a penalty not exceeding two hundred and fifty dollars together with ths amoant which should have been paid for sach license besides costs, may be imposed by the Mayor, lice Magi or Justise or Justi of the Peace coavicting; and for any and every violation of any othor part or por- tion of this by-law for which no penalty or penalties hereinb2fore imposed a pen- alty not exceeding two hundred and fifty dollars besides costs may be im- posed by the Mayor, Police Magistrate, Justice or Justices of the Peace convict- ing.
