Frye which came up before Police Magistrate Jordan today. Forin, who represents Frye, wished to compromise the case by paying for the tearing down of Milstein’s cabin and for the furniture broken. However, he was not willing to pay over $50, and Deacon, attorney for the plaintiff, refused - take less than $75. Later, Mr. Deaco wished to compromise but then Forin refused and the case went to trial. Samuel Milstein said he had paid $0 forthe cabin, besides 10 days extra labor and $6 for help. At the time it was torn down it was rented to Isaac Friedman. He was served by a ‘written notice to vacate, but refused to go until ordered to do so by the court. Frye had the cabin torn down and the furniture put outside in the rain. He said that one of the windows and a door were put in a shack belonging to Mr. Davis, who is Mr. Frpe’s partner. Mr Frve said in hie defense that he a ‘partner of F. § Davis, by and their bearing: on "he mining in- dustry ascertui “Tfjthe provincial legislature has thus clearly shown that has little sympathy with the eer” and _ fails to realize that its duty, the best interests of the whole province, is to aid and as- sist the mining industry; if this is the case in Victoria we cannot be surprised when we look tuwaids Ottawa so.dnd the new liberal government placing a import duty on almost eve article ot mining machinery used in this district today, the only ‘exception on favor of Portions of a concentrating plant.
