Civil Liberties Association. The association is recommending the provincial government get rid of the law, which could result in a person being jailed for up to six months or fined a maximum of $2,000. “We're not arguing no one should be detained for being drunk in a public place but it need not be an of- fence,’’ said association spokesman John Westwood. “We realize police perform a valuable social work function (when making an arrest under Sec. 43 of the Liquor Control and Licensing Act) and we did not want to disturb this power of police to helping people who are-at-arisk —- either fromthe elements or predators.’’ The report was prepared after Vic- toria resident Rod McCallum com- plained to the association that he believes police can abuse Sec. 43 of the Liquor Control and Licensing Act by arresting people who are not drunk but for other reasons, such as being belligerent.
