OCT. lst: “LEGAL NOTICE BY LAW NO. 25 SCHEDULE TO THE VILLAGE : —--MUNICIPALITIES 'ACT-- - THE CORPORATION OF THE VILLAGE OF CASTLEGAR Pees tA A NE LE A ae BY LAW No. 26. ‘ A Bylaw to authorize the Commissioners to accept a certain parcel of land to be used as a highway and to dispose of a certain part of a highway in exchange therefore, WHEREAS by virtue of Clause 59 of section 20 of the schedule to the ‘Village Municipalities Act' the Commissioners may pass a bylaw for the purpose of exchanging a certain par of a highway for a certain part of real property. : ; AND WHEREAS the certain. part of the highway aforesaid is known and described as the sesterly eight feet of part of First Avenue East commencing at the south east corner of Lot 4 Plan 1955 Lot 4598 Kootenay District which is at the intersection of First Avenue East and Twenty Fifth Street East in the Village of Castlegar, thence in a northerly direction along the easterly boundary of the said Lot 4 to its northerly boundary thence, in an easteraly direction for a distance of eight feet’ perpendicular to the said easterl@boundary thence in a southerly direction to the point of intersection: with Twenty Firth Street East): thencein-a westerly direction along the boundary line of Twenty Fifty Street East to the point of Commencement. - AND WHEREAS the certain parcel of land aforesaid is Known and described as the Easterly twenty fice feet of that part of parcel *C* (assigned) Plan 1520 Lot 4598 Kootenay District,. and registered under Certificatesof Indefeasible.Title No. 55197%I on file in the Nelson Land Registry Office. ” ‘ AND WHEREAS it 14s deemed expedient and necessary to widen that part of the highway known as First Avenue East on the westerly side of the centre line of the said highway between Twenty T.1rd Street East and the Southerly. boundary of the said par of Parcel tor (assigned) Plan 1520, Lot 4598. ; cae AND WHEREAS due. to existing buildings on the real property abutting on the westerly side of the said First Avenue East it had been agreed, prior to-the incorporation of the Village of Castlegar, between’ the owners of the real property affected of the first part, and the Department of Public Works of the second part, to widen the said highway on the westerly side of the centre.line for a distance of twenty five (25) feet only instead of the standard width of thirty-three.(33) feet, between Twenty Third Street East and the southerly boundary of' the said part of parcel *C* (assigned) Plan 1520 Lot 4598 Kootenay District. : - 2 AND. WHEREAS the real property adjoining the southerly boundary of the said par of Parcel © on the westerly side of the said First Avenue East and known and described as Lot 4 Plan 1955 Lot, 4598 Kootenay District had made a road allowance on the said plan of ‘ thirty-three (33) feet will be in excess of the road allowance of twenty-five (25) feet as agreed upon by the owners of the real property abutting on to. it and the Department of Public Works. ‘ AND WHEREAS the distance of eight (8) feet is the pmount that the road allowance of thirty-three (33) feet at the said Lot 4 18.4n excess of the road allowance of. the agreed width of twenty-five (25) feet and is the certain part of highway to be returned by this Bylaw to be merged into and form'part of the said Lot 4. . : AND WHEREAS 1t is deemed expedient and desirable that the said eight (8) feet of highway shall be exchanged for the said easterly twenty-five (25) feet’ of real property, thereby straightening the westerly boundary of First Avenue.
