The trial of a young woman who stole a pair of blue jeans from a store turned into an intense legal debate in provin- cial court in Edmonton. She admitted she drank so much on the day of the alleged crime that she remembers nothing between imbibing at a number of skid row taverns and waking up in the city jail “drunk tank.” In fact, she only discovered the reason for her presence there hours after her arrest for shoplifting. She found out, as well, that she had given police a name that wasn’t her own. “They told me about the blue jeans, about what I did,” she said in her testimony, geinning sheepishly. EXPERT INSTALLATION Phone 364-2537 801 Victoria, Trail, B.C. tin witnessed the shoplifting inci- dent described how the woman had picked out a pair of jeans, gone into a dressing room and emerged wearing the jeans. “I figured she would proba- bly leave with them on,” he said, The woman walked out of the store and was apprehended moments later on the parking lot, said the clerk. When confronted with the old jeans she left in the dressing room, she calmly removed the new trousers and pulled on the old pair—all under the startled gaze of the clerk and passing customers. “She was stoned,” the clerk told the court. “And when she did that, I.was sure.” _ The woman's defense coun- sel, Andy Sims, argued that the court could hardly convict someone of theft when that person was so obviously acting without intent. “One who is acting with intent would hardly drop her drawers in the middle of the department store,” he said. Crown prosecutor Jack Watson warned “there could be a dangerous precedent estab- lished" if the woman was acquitted of the theft charge. “Anyone could go out and drink to intoxication and then go out and do what they want and say they are not responsi- le.” He argued that in using voluntary intoxication as a defence there must be evidence showing the accused did not know what she was doing at the time she committed the crime. Mere belief of “alcoholic amnesia,”’ Mr. Watson said, should not be grounds’ for an acquittal. Provincial Judge P. C. C. Marshall smiled when both lawyers had concluded their legal debate. y “Gentlemen,” he stated, “what appeared to be a black- and-white case has become rather grey after hearing your persuasive arguments.” A The Judge carefully went over the young woman's actions from the moment she entered the store until she was placed under arrest for shoplifting. He concluded her behavior was rational and “consistent with intent,” including among his reasons that she picked out the right size of jeans for the exchange inside the dressing room. “Now if the whole thing were done more radically .. .” Judge Marshall found the woman guilty of. theft. He placed her on probation for nine months, adding the condition that she refrain from the use of alcohol. and take whatever courses necessary to combat her alcohol problem.
