ROSSLAND EVENING RECORD, SEPTEMBER 27 1900- LE ROI MINE GASE Gold Commissioner Kirkup on the Witness Stand. “STORY OF ASSESSMENT How He Arrived at the Conclsulon That Returns Were In- adequate. The hearing of the Le Roi mine case now pending was resumed at 11o’clock this forenoon before. Mr.: Keen, the only witness examined being Commissioner Kirkup who gave an account of the returns that, had been made, and the corr es- pondence that had resulted. Mr. Kirkup testified that he had received returns from the Le Roi management, but had not pased his assessment on these returns. . He had wiitten to the department with reference to the matter, and his let- ter of July 24, 1900, was placed in evidence, calling attention to the fact that a shipment of 38,665 tons had shown a value of only 62 or 63 cents net, the explanation. being the heavy shipping and -smelting charges, In making up the assessment Mr; Kirkup admitted that he had. oot entered or examined the Le Roi mine, nor had he examined the books of the company. He had based his assessment chiefly on the _ valuation and shipments of. the Previous year, when the total amount, as given by Mr, Macdon- ald was 92,500 tons, with a value of $1,250,000 gross. He had not inquired whether this was wet. or dry weight, nor had he made any investigation as to whether the value given was the market, value or'the value of the mine. He ad based his action wholly on heursay evidence. “He had not inquired as to the nature or terms of the: cdn~ tract with the smelter. Neither was he informed as to* the metallic conte nts of the ore. In a confiden- tial letter had heen informed that the charge for freight and treatment was $6, At the afternoon session yester- day William Thompson, as assist- ant general manager of the Le Roi Minmg company, testified as to ore . Shipments: that he checked all fig- ures before they were turned over to Mr, Curry, the figures bejng taken from the smelter returns, The shipments amounted to 38,665 tons dry. When Mr. Curry had been s2nt to the assessor’s office he had returned and reported to _Witness that the amount tendered was said to be insufficient. He had then checked over the figures and found them correct, in accordance with his understanding ol the law. These figures were then sworn to by Mr. Curry, Witness testiffed as to the deficiency lots, showing how. they were arrived at. Mr. Kirkup had not examined either the mine or the books, and how he had arrived at the gross value witness had.no idea, Witness went into iderabl R. Crewg of Vancouveris in the city.
