We believe that the Paris Belle people have won the sur- face rights on the Zenith claim amount- ing to 15 acres, and the right to the mineral of the balance of the Paris Belle which must of necessity carry with it the right to mine that mineral. If they have aright to mine at all, they will have a right to mine when they please, and although they may not have s right to sell surface rights they can prevent any one else from using it. Ifthe rail- road company has won the surface rights toall but the ground claimed by the Zenith claim, which would carry with it other surface rights, the company would probably be content. The spirit of the law is that the railroad grant is subject to the rights of the miner, and we be- lieve that the decision in this case will maintain those rights. The law very plainly says that the lands are granted to the railroad company subject to the provisions of the mining laws. There is still hope for the mining industry in the province of British Columbia with an honest judiciary A MATTER OF BUSINESS. Attorney-General Eberts evidently does not believe that railway presidents should be treated as harshly os private individuals when they take that which does not belong them. When the Nel- son'& Fort Sheppard railway bill was be- fore the legislature, J. M. Kellie present- ed affidavits from several free miners, stating that the railway company forced them to purchase the timber upon their claims when they wished to use it for mining purposes. The government had also knowledge of the circumstance that D. C. Corbin, on behalf of the Nelson & Fort Sheppard railway, had illegally col- lected timber royalties upon crown tim- ber from sawmill men and others. When these matters were publicly called to the attention of Attorney-General Eberts, his reply was that those aggrieved should should appeal to the courts. This is just sucha reply as one might expect from the provincial government, but in any other country, an attorney-general would be expected to at least protect crown property. Attorney-General — Eberts practically says that it is no business of his if railway companies seize crown property and extort a toll from free ininers before permitting them {to enjoy privileges reserved for them under the statutes of the province.—Nelson Trib- une. It is to be hoped that the members of the legislature will heed the protests that are coming in against the passage of the alien clause in the mining law. While it does not go as far as some peo- ple think, it nevertheless is calculated to do great injury the province. Kootenay dispatch says “it means that five thousand people will leave Koot- enay, and the mines will be closed with- in a week from the passage of the act.” The present system has worked well, and British Columbia has prospered ex- ceedingly under it.
