CLAIM-JUWN UMPING THEGUBANFRAUDS Case Against Smith Curtis Submitted | Revelations in Regard to the Customs to Supreme Court, DEFIANCE NO. | ATTACKED Owners of Townsite and Latest Out Ask That Smith Ourtis’s Olaim Be Deolared Invalid—Tho Defunct Parrot Claim Involved In the Controversy— Decision Reserved. Mr. Justice Drake,of the supreme court,.this morning completed the hearing of Rammelmeier et al vs. Smith Curtis et al, a mineral con- test involving a charge of claim- jumping against the defendants. The evidence was heard yesterday and this morning the case was ar- gued by A. H. MacNeill and W. S. Deacon for the plaintiffs and J. L. G. Abbott and J. A. Macdonald for the defendants. The court reserved his decision. The plaintiffs are the owners of the Townsite and Latest Out min- eral claims and the defendants of the Defiance No. 1 mineral claim in | this camp. The plaintiffs claim that theirs are the prior locations, having been mate in 1895, while the Defiance No. 1 was not located till December, 1899. The validity of the latter was supported by the] allegation that the ground in dis- pute was located as the Parrot mineral claim in February 1895, while the conflicting Townsite was not located till March of that year, and the Latest Out was staked still later. The Parrot location expired on February 16, 1899, and the de- fendants claim that the Defiance No. 1' was staked to cover this ground, which thus became vacant and open to location, the overlap- ping claims having been located on occupied ground and therefore being invalid. In reply to this defense, the plain- tiffs produced evidence to show that the Parrot never had been a valid claim, not being properly staked or surveyed and having conflicting de- scriptions of its lines, which over- lapped on the Derby ground. The Parrot location being invalid, they claim that the Townsite and Latest Out took its place as valid logations and that the Defiance No. 1 was a case of claim-jumping. To MAKE Qui ONNECTIONS. The time of passenger trains has not been definitely decided, but the westbound train will probably leave here at 7 instead of 8a. m, and the eastbound will arrive about 6:45 in- stead of 10:40 p. m. It is understood that an arrange- ment is under consideration be- tween the C. P. R. and the Red Mountain officials, .by which the south-bound train on the latter road would leave here about 11 p. m. and carry a sleeper and that the change jn time on the C. P. R, is being made in order to facilitate connec-| | tions.
