Supreme Court ruling Thursday modifying an injunction against work at the Vallican pit allowing removal of gravel already crushed, his client has opted to truck in gravel from eight kilometres away rather than spend more time in court and trying to obtain permits to operate the pit from the Agricultural Land Commission, the Regional District of Central Kootenay and the Ministry of Energy, Mines and Resources The injunction against work at the pit — which is on private property owned by Tibor Molnar — was obtained last month: by the Arrow Lakes Indian Band which is claiming aboriginal title to the area and fear the pit is disturbing ancient undiscovered remains due to the pit’s proximity toa known native burial site The band also opposed a limited permit issued by the Ministry of Mines allowing the crushed gravel. to be removed, but the ruling Thursday quashed the band’s ob. jections, Skogstad said An application to the RDCK for a permit under the Soil Conservation Act, which regulates all activity on land such as Molnar’s that is part of the Agricultural Land Reserve, was turned down by the RDCK board theeting Saturday Although the pit will no longer be used for the road project, Molnar may want to use the land ina similar way in the future, Skogstad said in explaining why the RDCK was asked to consider the application at its Applications for the removal of soil under the Soil Conservation Act are supposed to go first to the RDCK which then refers the application to the Agricultural Land Commission for comments.
