For years, generic-drug firms have bottled, packaged and shipped their products to drug stores and hospitals across the country. The drugs are sold usually only under a chemical name at much lower prices than their brand name equivalents. “No-name” drugs, as they are called, have been a boon to consumers, hospitals and provincial drug-benefit cof- fers but are bitter medicine for multinational pharmaceu- tical companies who hold pa- tents on drugs copied by the generic firms, Under section 41 of the Patent Act, generic firms li- censed to produce patented compounds must render a four-per-cent royalty to the patent holder. The system, known as compulsory licensing, was introduced in 1969 after sev- eral government commis- sions declared that drug prices in Canada were jump- ing to artificially high levels because of lack of competi- tion in the industry. Provincial legislation fol- lowed, enabling pharmacists to substitute lower-priced generic drugs for costly brand names when filling prescriptions.
