‘British ‘C CASTLE NEWS, € THURSDAY, FEBRUARY 7, 1952 Take notice that the following is a true copy of the proposed bylaw upon which a vote of the electors will be taken at the Kinnaird Hall, Tuesday, February 19, between the hours of 9:00 a.m. and 7:00 p.m. “THE CORPORATION OF THE VILLAGE OF KINNAIRD” BYLAW NUMBER 24 A. By-law of the Corporation of the Village of Kinnaird, here- inafter called the “Corporation,” to authorize the raising by way of loan of the sum of seventy-three thousand ($73,000.00) dellars for water works purposes. WHEREAS it is deemed desirable and expedient to purchase the water systems owned and maintained by the Kinnaird Water Company situate upon the Columbia River and by Mr. N. Kuryluk of Kinnaird, B. C., situate upon Merry Creek, respectively. AND WHEREAS the said Kinnaird Water Company of Kinnaird, B. C., has agreed to sell to the said Corporation all its rights, titles and interests in the plants, equipment, pipelines, including real and personal property, licences, rights-of-way and easements and all other assets whatsoever comprising its water system for the con- sideration of fifty thousand ($50,000.00) dollars in cash, AND WHEREAS the said Mr. N. Kuryluk of Kinnaird, B. C., has agreed to sell to the said Corporation all his rights, titles and interests in the plants, equipment, pipelines, including licenses, rights- of-way, and easements and all other assets whatsoever com- prising his water system for the consideration of twelve thousand one hundred and eighty-six dollars and six cents ($12,186.06) in cash. And WHEREAS it is deemed advisable and expedient to renew, reconstruct and extend and consolidate the aforementioned water systems. AND WHEREAS the estimated cost of such renewals, recon- struction and extension in nine thousand six hundred and eighty ($9,680.00) dollars. AND WHEREAS the total estimated cost of the work to be done including the purchase of the aforementioned systems is the sum of seventy-one thousand eight hundred and sixty-six dollars and six cents ($71,866.06),.together with a sum of one thousand one hundred and thirty-three dollars and ninety-four cents ($1,133.94) for By-law and Debenture expense, makjng a total of seventy-three thousand ($73,000.00) dollars. AND WHEREAS it is advisable and expedient to borrow the said sum of seventy-three thousand ($73,000.00) dollars which is the amount of the debt intended to be created by this By-law. AND WHEREAS a provisionial certificate of approval to the undertaking has been received from the Provincial Health Officer. -AND WHEREAS pursuant to Section 32 (b) of the Schedule to the Village Municipalities Act, approval of the Inspector of Muni- cipalities has been obtained. AND WHEREAS the amount of the taxable assessed value of the land within the Village is three hundred and two thousand four hundred and twenty-five dollars ($302,425.00) (gross less exemptions), and’ of the improvements within the Village is four hundred and thirty-one thousand four hundred and fifteen ($431,415.00) dollars (gross less exemptions), according to the last, revised Assessment Roll being the Assessment Roll for the year 1951. THEREFORE, the Board of Commissioners of The Corporation of the Village of Kinnaird, in open meeting assembled, enact as follows:" 1. The Board of Commissioners be and it is hereby authorized and empowered to purchase the aforesaid water systems of the Kin- naird Water Company and Mr. N. Kuryluk of Kinnaird, B. C., and to make payment in cash to the Kinnajrd Water Company in the sum’ of-fifty thousand -($50,000.00) dollars and Mr. N. Kuryluk in the sum of twelve thousand one hundred and eighty-six dollars and six cents ($12,186.06). ase 2. That the Board of Commissioners be and is hereby authorized and’ e! wered to renew, reconstruct, extend and maintain and operate ‘within the Village, works for the supplying for any and all purposes, water to the inhabitants of the Village and without limit- ing the,generality of the foregoing, is authorized and empowered: ~a). To develop a source of supply. (jb)* To lay supply and distribution mains. “(c)@ To connect domestic services. (d) To instal booster pumps, fire hydrants, and standpipes. (e). To construct other necessary works in conjunction with the said water systems. ‘ (1? To apply for and obtain all necessary water licenses. (g)' To acquire any necessary lands or easements. 3. That for the purposes and objects of aforesaid there may be borrowed upon the credit of the Corporation the sum of Seventy- One Thousand Eight Hundred and Sixty-Six Dollars and Six Cents ($71,866.06) tegether with a sum of One Thousand One Hundred and Thirty-Three ‘Dollars and Ninety-Four Cents ($1,133.94) for by-law and debenture expenses, making a total of Seventy-Three Thousand Dollars; ($73,000.00) and debentures may be issued therefor in amounts of not less than Five Hundred Dollars ($500.00) each and all such debentures shall be sealed with the seal of the corporation and signed by the Chairman of the Board of Commissioners and the Clerk thereof. zn 4. The said debenture shall be dated the first day of November, 1951 and shall be payable as follows: The sum of Two Thousand Dollars ‘ ($2000.00) on the first day of April, 1953, and a further sum onthe first day of April, of each and every successive year thereafter; the amount payable in each such year shall be as sft out in the table contained in Paragraph Seven of this Bylaw. 5. The said debentures shall be expressed to be payable and shall be payable both as to principal and interest in lawful money of Canada at the principal office of the Bank of Montreal at Castle- gar, British Columbia. = ylhe said debentures shall have attached to them coupons for the payment of interest at the rate of five per centum (5%) per annum payable half-yearly on the first day of October and the first day of April in each year during the currency thereof, and the signatures to the said coupons may be either written, stamped, printed or lithographed. 7. There shall be levied and raised during the currency of the said debentures by rate sufficient therefor, over and above all other rates, 9n-all the rateable land or land improvements within the Village,- for the payment of interest in the respective years the amounts as follows: . There shall be set aside in a separate fund distinct from all other funds of the Corporation the proceeds of all water rates, rents and-charges which shall not be intermingled with other funds of the. Corporation and which shall be paid out only for the following purposes: (a) Payment of the debt herein created, consisting of repdy- United Church Elects Officers The United Church annual congregation meeting began with a pot luck supper with fif- ty members and adherents pres- ent. It being Mrs. L. C. Johnston's birthday, Mrs. J. SHerbiko, the president of the W. A., present- ed her with a corsage and a gift from the members. . With the clearing of the ta bles, the youngsters present, along with some adults sang hymns, after which the business of the meting took place. The financial report for the year was given by G. Santano. Mrs. McPherson gave the fi- nancial report for the, W. A., which showed a very successful and busy year. Mrs. J. Sherbiko gave a full report of the W. A.’s activities for the year, highlighted by the Easter Sale, Thanksgiving din- ner and Christmas sale. The general .report for the Sunday School was given by Mrs. J. Lipsett and showed an increase in membership, which now stands at 95. The financial report for the Sunday School was given by Mrs. 'M. Peachey. Mrs. J. Gemmill, secretary of the M. of M., gave the financial report for Missionary and Main- tenance. The election of officers for the coming year took place with the following being elected: Board of Stewards, C. Lundgren, Mrs. C, Fraser, R. Hunter, R. , L. E. Davis, J. T. Dun- lbs L. Grunerud and J. M. Dun- lop. Elders W. Easton, J. Lipsett, and J. Gemmill, C. Lundgren was elected as auditor for the year. Mrs. J. Gemmill was elected as Missionary and Maintenance convener, treasurer Mrs. C. Fra- ser and secretary Mrs. L. Grun- erud. J. Dalziel gave a report on the activities of the choir and was elected as choir leader for the coming .year. A vote of thanks was given Mrs. Thatcher as organist. Funeral Held Saturday Funeral services were held on Saturday at Brilliant for little Helen Mary Faminoff, eight-year- old daughter of Mr. and Mrs. William M. Faminoff of Brilliant. She died last Thursday in the Trail-Tadanac hospital, after a lengthy illness. I.0.D.E. to Honor Mrs. M. Pellent At Luncheon The Lillian Killough Chapter 1.0.D.E. executive met at home of Mrs. J. Gemmill on Mon- day evening with the Regent Mrs. J. Deans presiding, and 14 members present. The regent read a very inspir- ing and encouraging letter from Provincial President Mrs. M. Pel- lent who will honor the chapter with a short visit on Tuesday, February 12th. Mrs. Pellent is anxious to meet as many members of the chapter as possible, and a luncheon has been arranged in her honor for that day. AlI members are re- quested to attend the luncheon, which will commence at 12:30 in the Twin Rivers hall. The annual meeting will take place, as previously arranged, on Monday evening, February 11th. The secretary, Mrs. V. Goresky, read a letter from Mr. W. Mar- kin, secretary of the Castlegar Library Board, thanking’ the chapter for the $100 donated to the library in the past year. One application for new mem’ bership was received by the ex- ecutive. Buckna, with Mrs. Thos. Fourt presiding. Business discussion centered around the Barn dance to be held Februray 22nd. Further committees were appointed to act in various capacities. Father Barnes spoke on the spiritual significance of Lent, Stating that their would be Mass each Wednesday morning and the Way of the Cross each Wed- nesday evening in St. Joseph’s Chapel in Kinnaird during the Holy Season of Lent. (b) Payment of the cost of operating and maintaining the said water works system. (c) Repayment without interest of any sums advanced by the Corporation. . (d) Payment of the costs of the construction of or extension to the said water works system. (e) 9. It shall be lawful for the Corporation to re-purchase from time to time, any of the said debentures at such price as may be mutually agreed upon, and no re-issue of any such debentures shall be made in consequence of such re-purchase. 10. This By-law may be cited as “KINNAIRD WATERWORKS LOAN BY-LAW NUMBER 24, 1951”. READ a first time this 3rd day of September, 1951.
