Smith chats about
justice reform

The average British Columbia deserves an
accessible, understandable, efficient and inexpen: e
legal system, the provincial Attorney General says.

Bud Smith, who was in Castlegar Thursday talking
to Kootenay County Bar Association members about
proposed changes to the province's legal system, said
average citizens should not have to feel intimidated by
“archaic” legal language:

“We'll be looking at writs, we'll be looking at other
pieces of process that are presented to individuals so
that they can understand the language,” he told
reporters while in Castlegar. “The language is quite
archaic in many instances and really doesn't mean
anything to some people.”

Smith's four-hour whistle stop in Castlegar was
part of a province-wide tour he has undertaken to
discuss a recently completed report on the province's
legal system.

The Report of the Justice Reform Committee
initiated: a year ago and just completed at a cost
about $250,000—makes 182 recommendations
improving peoples’ access to the legal system.

Recommendations in the report include raising the
amount of a claim in small claims court to $5,000 from
the current $2,000, issuing tickets similar to speeding
tickets for municipal violations such as noise bylaw
infractions and making Supreme Court services more
available to small communities such as Castlegar.

“The thrust of the report is to take before a judge,
to use a judge's time, to hear only those issues which
truly are in dispute,” Smith said. “And to try to solve all
other issues either before you go to court or in some
other form. If you successfully do that, obviously, it'll
free up more judges’ time with the number of judges
who are there.”

Smith also said there are recommendations for
improving the availability and cost-effectiveness of
family matters in the court. Currently, family matters,
such as child custody cases, can be started in provincial
or Supreme Court. Smith said custody cases can get
lengthy and costly when two parents are fighting for
the custody of their children in more than one provincial
court

litigants but also for the society that has to pay for that

Dam builder caught
in middle of dispute

A Crescent Valley man who is in
the process of building a small power
generating dam on Norns Creek
about 16 kilometres north of Castle
gar has gotten caught in the crossfire
of a dispute between a Regional
District of Central Kootenay director
and the provincial Environment
Ministry.

Area J Director Martin Vanderpol
is annoyed that the Environment
Ministry along with numerous
other ministries or their branches —
has given Ron Hoodicoff permission

to build the dam in the Robson
Raspberry watershed before con
ducting a study of the environmental
affects of additional development in
the watershed. Vanderpol had re
quested the study and was surprised
to learn in a letter he received Dec
10 from the Environment Ministry
that Hoodicoff could proceed with the
dam.

“I want it clearly understood that
I, in principle, am not attacking the
project that Mr. Hoodicoff intends to
do,” Vanderpol told the Castlegar
News Saturday.

“What I wanted is a study done of

that watershed to see whether it can
bear it (additional development) and
that has not been done,” said
Vanderpol, who met with Hoodicoff
yesterday morning.

“So that's what I am really of.

the hopes this holiday season of local Grade 4
students who came up with a “Wish List for the
World” during a special one-hour lesson on peace

high school in South Slocan, four Grade 9 and 10
students from the school’s Conscious Party worked
with Mike Rodgers’ Grade 4s at Kinnaird on defining
peace and listing activities they can do to make the
world a better place

The students capped the lesson by making
traditional Japanese folded paper “peace cranes.”

“I think it works a lot better than top down to
the bottom,” Cabral said of having the Grade 9 and
10 students work with younger children. “They're
not peers, but they're closer than adults to children.”

promising to fold little origami figures out of the
