He explained that he had only consented to take up election cases on former occa- sions for the reason that no other judges were but as this dition no longer obtained, he would refuse to hear any-farther motions arising out of the elections, on account of his participation in them. It was for commenting upon the non-desirabjlity of Justice Martin hearing the Lillooet case that W. H. Ellis and C. H.
