Court of Appeals ruled that the registered owner of a motor vehicle couldn't be charged unless he could be visibly placed at the scene.To lay charges based on licence plates only was a violation of the Charter of Rights because there was a potential for a jail term. If the prosecution couldn't prove that the registered owner was driving the vehicle at the time of the. offence, there was no conviction. Ultimately, this forced police to refuse to follow up a report, unless they had a name or an eyewitness. However, the law’s status has now changed.
