CASTLEGAR NEWS, Thursda April_20, 1972 | Victoria Proclaims Family Relations and Estate Administration Acts Two Acts which were introduced at the recent session of the legislature af- fecting family relationships and administration of es- tates, have been proclaimed by order-in-council, The act to amend the Administration Act il come into force on June 1. Attorney-General Leslie Pet- erson in outlining the pro- visions of the act sald, ‘She basic purpose of the Ad- ministration Act is to set out the basis for the distri- bution of the estates of de- ceased persons. These am- endments will update the Act and bring it in line with modern day society.” Under the present law, if a man dies and leaves no will, his spouse and child will each receive one- half of the catte after pay- ment of $20,000 to the wi- This new amendment also "entitles his spouse to a life interest in the matri- monial home, as well as her share of the estate. Protection is also pro- vided under these new am- endments for a common-law wife and illegitimate child- ren. Previously they were limited to $500 or 10 per cent of the estate which- ever was greater. When this act comes into effect on June 1, the courts will de- clde at their discretion what amount should be awarded from the estate to a com- mon-law wife or illegitimate child, taking into account all the circumstances. Another major amend- ment is the provision that in every estate of a deceased person, all the beneficiaries or anyone entitled to any interest, have to be given changes iclude procedure in the Family Court to be read- ily available and the family judge will have wider dis- cretion to deal with all pro- blems a matrimonial cage.
