The Nelson & Fort Sheppard railway company is notifying all occupants of building Tocated on the so-called railway addition to pay rent therefor only te that company. Eighteen writs of eviction were issued yesterday. Defeated in its tricky and un- business like attempt to inveigle the people into signing a contract which under a possible contingency, would amount to an absolute swin- dle, the railway compaay now evi- dently proposes to remove the “squatters” in the midst of winter and after the company had rested on whatever rights it may have for a long time. Hew much better and reasonable and business-like it would be, if the railway company notified the “squatters” that if they would agree to deposit in the bank an agreed upon price, either in lump sum, or by installments, the rail- way company would deposit along with the money u general war- ranty deed. Here are twenty suits for evic- tion already instituted. It is pos- * sible, maybe probable, that the “ mumber-of these suits may run into the hundreds, with all the attend- ing annoyance, inconvenience and expense that the railway company can bring about. As a proposition, it being a fact that the possible success of the railway company in these cases will in nowise determine the real controversey over the title to the land in question, the people and this community have certain general claims that are entitled to reasonable recognition in this mat- ter. The just consideration of the claims of the railway company must involve the just consideration of the claims of the people, The railway company goes into court with unclean skirts. As a prop the r ble presumptions should run in favor of the people. It is also a consideration, that in all probability the legislature will, during the next session, cancel the railway grant for irregularities. CORB BS AMAIVAL. D. C. Corbin is in town. The Story of How He Won Millions in the Transvaal. R. E. Brown of Spokane has related the story of the incidents which have made him one of the richest men ‘in the Transvaal. “Before going into the merits of this case,” said Mr. Brown, “I should give an idea of the laws which govern the acquiring of mining claims in South Africa, as they differ most materially from those in this country. When the owner of a farm discovers gold upun his land, or has reason to believe that it is goldbearing, he signifies jis intention of baving it proclaimed a public diggiug. When he gives his notice, the government thereupon is— sues a proclamation throwing the land open for location upon a certain date, in the similar manner to the custom in the United States when an Indian reservation is thrown open to the public. It requires thata 60 days’ notice be given and is published from day to day for that length ‘of time. The provisions of the act are such that it allows the man to reserve 15 per cent of the whole reservation for his own use. “Whoever comes iu first and locates after the land is thrown open, is en- titled to what he settles upon. The opening of this land in question,which is near Jonannesburg, had been pub- lished for sixty days in the papers, andI,who was on the ground and who ‘had been taking careful note af the character of the ground, had made prepurations to locate, or peg out, as they call it, as much ground asIcould on a large scale. I had over 1000 men on the ground before the day came around, all in my pay and well organized. Charles Butters, the noted American ct was one that the government having announced the opening of the land in 60 days by proclamation and the 60 days having expired at mid- night, the ground had been opened érom midnight to the time when the official had announced that he would postp the i of li for an hour, and that therefore I had the right within that time td file upon the land and was entitled to a license; that no petty official had the right to refuse to issue it to me in face-of the action by. the government; that I had tendered the money and had made the demand, and I maintained that this was equivalent to a license, and no -| official could withhold what I. was en- titled.to by law. The 60 days had expired on the midnight of Thuraday, and the morning of Friday -was the time when the licenses should have been issued. “It seems that on Thursday eve- ning the executive council, which cor- responds to the cabinet of this coua- try, but whose powers are simply executive, although they assume both legislative and judicial, had met and had passed a resolution of recision, calling off the proclamation. I main- tained that the executive council beds no right to de-proclaim. a farm thal had once been opaned by proclama- tion, and that in any event it required. degislation, but that no legislation could interfere with vested rights once acquired under such a proclama- tion. It happened that at this time the legislature was in session, and for fear that they would attempt to remedy this error on the part of the government, I had filed my complaint and had the summons -served. The legislature, three days after this had been done, passed an executive besluit, as they call it, or a resolution, ratify- in the action of the executive coun- cil, After they had finished the legis- lative action and the suit was well under way, they passed a new law changing entirely the system of land tenure, under v.aich I had made my claim on this land, and they decreed (Continued on Page 3.)
