October 12) 1988 Company sued for oversellin TORONTO (CP) — Overselling in the hiring process, or making prom- ises that can't be kept, can be ex- pensive practices for a company. This is particularly true since a recent court case threw a monkey wrench into employment law in Canada, says lawyer William Gale. The case is Queen vs. Cognos, in which Douglas Queen won $67,000 in damages for negligent misrepresen- tation from Cognos Inc., an Ottawa computer software firm. Recently, Gale's law firm and the executive search branch of Coopers and Lybrand Consulting Group held a seminar to show companies how to avoid falling into the trap that caught Cognos. Queen was hired to help develop a line of computer software modules, but the company had never formally LIBERAL KANSAS approved the project and curtailed it shortly after his arrival, transferring him to fill-in jobs before finally let- ting him go. Even if the case is reversed on appeal, Gale said, it has opened up a new area in employment law. In the Cognos case, Gale explained the court took into account implicit representations that had been appear in the employment( agree- ment. SETS LIMIT They were to the effect that the project he was being hired for would last about two years and involve doubling staff in his area. Because of such promises he left a Calgary job to move to Ottawa. Marnie Keith-Murray, manager of exeuctive search for Coopers and Lybrand, said the case. revealed several problems: Although the company had no human resources department, it hadn't sought outside help, nor did it appear to have systematic hiring procedures or pol- icies. In sales-driven entrepreneurial igh-tech companies, more attention often paid to the marketing and financial side of planning than to the human side, she said. With lean management, some de- cisions may be made without long- term planning. Gale and Brian Grosman, senior partner of the firm, suggested a comprehensive clause be included in employment contracts saying the document constitutes the sole agree- ment between the parties. This wouldn't provide total pro- Utilicorp buys utility By CasNews Staff UtiliCorp United Inc. has pur chased another U.S. utility. Utili Corp, the parent company of West Kootenay Power Ltd., has signed a purchase agreement to acquire the natural gas distribution system in Liberal, Kansas, which serves 7,000 natural gas customers. The deal is subject to regulatory approvals. Payment is to be made primarily with 80,000 shares of Utili- Corp common stock, valued at $1.5 million, plus payment for related utility assets. The newly-acquired system will become part of UtiliCorp's Omaha based People’s Natural Gas divi sion. Wrecking big business VANCOUVER (CP) — Every 51/2 hours, a home is torn down in Vancouver. “T'll come up the driveway, station (the backhoe) six metres away, lift the boom in the gir and begin clawing away at the house,” says backhoe operator Chris Bauder. “With one pass of the arm, I can pass the bucket through the roof, the ceiling, the front wall and then pass right through the floor of the house tothe basement ... it takes about 15 seconds.” Bauder needs only 20 minutes to an hour to flatten a house. Aside from new developments in the suburbs, contractors are knock ing down older Vancouver houses in established neighborhoods or on larger plots of land, making way for townhouses or grand mansions for affluent buyers. The trend has boosted the demol ition business. Statistics from the city's permits department show that five years ago, the demolition rate was a home every eight hours and six minutes. “The last three years in demolition (of all kinds) have been very good,” Archie Murdoch, demolition manager for Pacific Blasting, said. “This year has been a little spotty.” ENTER MARKET The building boom has increased competition in residential demolition, says Murdoch. “Anyone with a backhoe will do residential demolition,” he said, adding larger companies such as Pacific Blasting bid mostly on higher paying commercial and industrial contracts. “This purchase reflects our com- mitment to the natural gas business and our commitment to expand our base through isiti and economic development,” said UtiliCorp president Richard C. Green Jr. “We are always seeking growth opportunities in all of our states,” The Liberal gas system was pri vately owned but regulated by the city. In 1987, operating revenues were $3.5 million. It now will become 4 part of Peoples’ Kansas operations which are regulated by the Kansas Corporation Commission. With the acquisition, Peoples will have about 39,000 customers in Kansas and about 316,000 residen- tial, commercial and industrial’ cus- tomers in the five states it serves. tection for a company but it could go a long way, Gale said. “You might also consider drafting an actual written seript of the content of the interview ahead of time to hit all points,” he added.
