Roman Popadiuk, the deputy White House press secretary in Los Angeles with vacationing President Ronald- Reagan, said two F-14-jets from the aircraft carrier John F. Kennedy’returned safely to the ship after the confrontation. Two parachutes from the downed Libyan aircraft, reported as Soviet built MiG-23s, were sighted. “The Libyan aireraft approached the U.S. aircraft in a hostile manner over international waters and the U.S. aireraft, acting in self-defence, fired air-to-air missiles, downing both of the Libyan aircraft,” Popadiuk said. He said they “were threatened while conducting routine operations in international airspace north of Tobruk,” a. Libyan port. NEAR CRETE Pentagon-sources who demanded anonymity said the Kennedy task force was cruising in the Mediter-. ranean south-southwest of the Greek island of Crete, about 200 kilometres north of Libya, and the F-14s were flying nearby when the incident occurred about noon (5 a.m. EST). The two MiG-23s were spotted by radar taking off from the Al Bumba airfield in eastern Libya. “They came out and headed directly for the F-14s,” said one source. “The F-14s manoeuvred to determine the intent of the Libyan aircraft, but every time they turned the Libyans followed,” one source. “The F-14 pilots made the decision to shoot after the Libyan aircraft turned on their targeting radar. That decision you have to make in the cockpit.” The source said there were no indications that the Libyans fired before they were hit by air-to-air missiles. # Senator Sam Nunn, chairman of the Senate .armed services commit tee, said: “Indications are that Libya violated what we call the rules of PUR a themselves into a position to be able to shoot down American planes. The rules of engagement permit self defence in those circumstances.” “Under those circumstances . . . clearly it was Libya that took the provocative action,” Nunn (d-Ga.) told the Atlanta radio station WGST. DANGEROUS ACTION In Rome, Libya’s ambassador to Italy, Abdel Rahman Shalgam, called today’s incident “a unilateral act” and a “dangerous” action. He declined to say how Libya would respond. Reagan was awakened and infor- med of the battle about an hour after it occurred, Popadiuk said. He said national security adviser Colin Pow ell telephoned the president after speaking with White House chief of staff Kenneth Duberstein. Woman's body found in deep freeze by daughter PLYMOUTH, Mich. (AP) — A daughter haunted by nightmares about her mother’s 1985 disap- ~pearance pried open a locked base ment freezer and found the woman's battered’ body, prompting her fat her's confession to the slaying, police say. Leonard Tyburski, who told police he kept the body in the freezer for 3'2 years because he loyed his wife and didn’t want to part with her, was charged with murder, author ities said. “It has some indications of Edgar Allan Poe and ‘even some Alfred Hitchcock,” said District Judge James Garber, who arraigned Ty burski and ordered him held without bond. Garber delayed scheduling a pre liminary hearing until Tyburski, 45, underwent psychiatric tests to deter: mine whether he was competent to stand trial. Tyburski, dean of students at Detroit's Mackenzie highschool, had “co-operated with police investigating his wife's disappearance. Dorothy Tyburski was 37 when he reported her missing on Oct. 2, 1985. Tyburski passed a lie-detector test and hadn't been considered a suspect, police said. The case, treated as a: missing person report, had been closed for two years. Disturbing dreams by one of the couple's daughters led her to suspect her mother's body was in the house, police said. Kelly Tyburski, 20, an art student at Michigan State University, “had nightmares or dreams or whatever you want to call them, that her mother was in a place where she couldn't move, either tied up or locked up,” said police detective Richard Pomorski of Canton, a middle-class community 40 kilo metres west of Detroit. She didn't suspect her father until she remembered the freezer had Cyanide been used before her mother's disappearance, and the key to it had disappeared, he said. Later, detective Keith Lazar said, the daughter's dreams gave way to suspicions .when Tyburski began making up stories about why the key was “missing. On Monday, she pried the lock off the freezer while her father was away, police said. She found blood on the lid and sides and her mother's clothed body bent over meat wrap ped in butcher paper, police said. Kelly Tyburski_and her sister, Kim, 16, called a friend who drove them to the police station, ignoring their father as he returned home, detectives said. Police obtained a warrant and arrested Tyburski. Later, Tyburski-—told- police -he killed his wife during an argument on Sept. 28, 1985, Pomorski said. “It appeared he felt sorry for her,” Pomorski said. “He kept her in the basement for 3'/ years. His reason was that he loved her. He didn’t want to part with her.” The cause of the death remained undetermined pending an autopsy, Lazar said. found in yogurt container PHILADELPHIA (Reuter) — A 17-year-old New Jersey high school student is in critical condition after eating yogurt laced with deadly cyanide, police said. The Camden County, N.J., prose cutor's office said Thomas Lee of Haddonfield became ill Tuesday after eating part of a 226-gram container of Breyers yogurt — Food and Drug Administration ‘tests confirmed the yogurt was taced with industrial cyandie, usually fatal in small doses, a police spokesman said. Police said Lee's mother bought the yogurt Jan. 1 at a grocery store in Westmont, N.J. It was manufact ured in New York state on Dec. 21. The prosecutor's office said it was {60 eafly to tell -how-or-where-the tampering occurred or how, wide spread it might be. Camden County Prosecutor Sam uel Ashell said, {We have not ruled out anything.” Aébell's office added that tests conducted on other yogurt found at the Westmont store proved negative. Comment from Dreyers was not immediately ‘available. In Washington, FDA spokesman Bill Grigg said: “It seems to be an isolated instance. We haven't found anything that would appear to indicate other tampering there and it is not clear whether this is a tampering." ~~ The first cyanide tampering cases arose in-the Chicago area in 1982, when seven people died after taking poisoned Tylenol. At least five people have died in.food and drug tampering cases since. A spate of tampering cases began in February 1986, when a young woman in Yonkers, N.Y. died after taking cyanide-laced Tylenol. Susp- teious cases involving soup and pain killers arose in Seattle, Nashville and Runnymede, N.J., which is in the same county as Haddonfield. The Runnymede case involved a 21-year-old man who died after eating cyanide-laced instant chicken soup.
