For many, it’s their final stop in lengthy disputes. Some are appearing in a courtroom for the first time and, repre- senting themselves, are intimidated by the black-robed judge who sits high above them, backed by the ornate, gold- embellished emblem of the court. But Judge S. Douglas Turner, head of Ontario provincial court, small-claims division, says people should “feel free to represent thentSelves. “The only caution I would give them is to make sure they are well-prepared. Have all the facts at their fingertips and all the documents relevant to their case.” Un a recent morning, Peter Diamantopoulos, a short, heavy-set man who speaks no English, was the first to appear before Judge Michael Fitzpatrick in a small-claims courtroom in d Toronto. Di 's daugh- ter, Antonia, transjated his testimony from Greek. PAID DEPOSIT Under questioning from his lawyer, Harvey Hacker. D los said that in Ni 1984 he ordered a furnace from Eskimo Refrigeration Ltd. and gave them a deposit for $1,200. The cheque was cashed but the furnace was never delivered, and eventually Diamantopoulos bought one from another company. Eskimo Refrigeration had no representatives in court and, with the order form and cancelled cheque submitted as evidence, Fitzpatrick awarded Diamantopoulos $1,200, plus $150 interest. Turner says that, with 40 to 45 per cenf-ef claimants in Toronto representing themselves, judges in small-claims court “often have to cool things down. “Some people get a little emotional and that tends to throw them off stride.” Toronto small-claims court sees more lawyers repre- senting clients because the limit on a claim is $3,000, compared with $1,000 in the rest of Ontario. The Toronto limit was raised in 1979 as an experiment and several con- sumers’ groups, as well as Turner, argue the ceiling should be raised across the province. LIMIT VARIES In other parts of the country, the small-claims limit ranges from $1,000 in Quebec and Manitoba to $3,000 in Saskatchewan and the Northwest Territories. Turner says small-claims courts are set up so that non- lawyers can argue even complicated cases. In Quebec, lawyers are not even allowed in small-claims courts. Clerks are trained to assist people in filing their claims and making sure the forms are filled out properly, defendants and witnesses are notified, and summonses to appear are issued. But the clerks cannot give an opinion as to the validity of the claim. Partial lawyers’ fees can also be awarded and legal-aid is available for those who qualify. without even appearing in court. Turner says many of the cases filed are settled before they come to trial — either through negotiations, default judgment, or pre-trial conference in which a judge and the parties involved “have a nice chat about it all. . . with a view toward hopefully arriving at a settlement.” To help reach that end, the judge will give his opinion on the merits of the case, urging the party in the wrong to either pay up or drop the case. Only Ontario, Prince Edward Island and Yukon offer such mediation. If the parties still can’t agree, they go to trial in front of a different judge, who can question witnesses at length and hear evidence that would be inadmissible in a higher court, such as hearsay. GET FACTORS Judges can also ask questions in higher courts, but tend to do so more often in small claims where many of the cases are presented by non-lawyers. “The function of a judge — at any level — is to search out all factors relevant to reaching an ultimate decision,” Turner says. Once a judgment is awarded, the fight may not be over — the successful claimant may have to return to court to force the recalcitrant debtor to pay up.
