H. Falding has wowed his office into. the new Bank of Montreal not smell coal oil. He was not then looking for fire, but: for some man who had tried the door. He pre- sumed the prisoner sold coal oil and that left in the vessel might be there in the natural course of trade. He did not know how long the oil- soaked stuff might have been there. He did not.see the accused when he discovered the fire. There: is a hall door leading from the lodging house on the west, opposite the side door into the prisoner’s. store. “He thought nobody could’ have lighted the fire and gotten up to this door, but it might have been done. Officer McDonald corroborated Officer Raymer's testimony as to their: movements and told of Officer. Raymer’s placing him on guard. He hed the building and could see fire’ and, while doing so, ‘iced kerosene on the walls. The patch of kerosene on the prisoner's build- “ing was about five feet high and five feet eight inches wide and on the opposite building about four feet high and 20 feet wide. He sounded his police whistle, came back, jumped down between the buildings, picked up some earth and paper, which smelted of oil. By this time two persons came from the International—the night porter and the waiter. He kept the earth and paper and produced it in a gunay sack, also a hair of boots. These were put in evidence as exhibits. He noticed that the boots, which were between the two buildings on the ground, di. + were ii of coal oil. Witness then climbed up on the _idewalk, found Officer McDonald left him in charge with instructions ‘to see that no one passed it: or out of the building, and went for the chief. The latter returned with him and went into.the building. All this had occupied 30 or 40 minutes, during which he did not see the accused. He could see clear into the other end of the building.
