CASTLEGAR NEWS, January, 19, 1983 “pros wars | tu rning ‘white-hot’ ‘The Canadian Press Canada’s pharmaceutical wars have turned white-hot, with multinational companies pitted against a few small Canadian concerns on a battleground created by the federal government, At stake is more than $1.5 billion a year in drug sales and of jobs in h and The multinationals claim federal laws kill the financial incentive to develop and market new drugs in Canada by allowing the small companies to, steal their ideas and potential profits by putting out their own generic copies, Some of the multinationals have already pulled their research operations out of Canada. Others are threatening similar moves unless the laws are changed. _ The smaller xf many Canadit d, argue their generic products are cheaper — thereby Towering costs to and pi throug! d hospital and p: ial drug plans. They ‘also argue the law allows a Canadian presence in an industry that would otherwise be 100-per-cent foreign owned. OBTAINS LICENCE The government, in effect having created the battle: ground, now finds itself stuck in the middle of ‘the fight — sensitive to the loss of precious research and development jobs, but unwilling to do anything that‘ could ead to dp increase in the cost of drugs. Under a 1969 federal law, a‘company can obtain’ a” licence to copy an innovator's drug instead of being forced to develop its own version. In return, the: company marketing the generic drug has only to ‘pay the originator’ a four-per-cent royalty on sales, a piddling amount when stacked up against the 15- or 25-per-cent fees that are the norm in voluntary licensing arrangements, ™ Since 1969, moe than 175.compulsary licences have L been issued on ‘about 30 drugs, and only rarely, has Ottawa” : refused to ‘issue. one. Also harmful to the multinationals are provincial drug benefit laws that require parmacists to provide the cheapest brand to patients who qualify for free. drugs, unless the The rati ale behind the law is to promote lower drug costs, and despite conflicting statistics from each side, it appears to have achieved this LOWERS DRUG BILL * Arecent Economic Council of Canada study found that although generics have captured only seven per cent of the total prescription drug sales, they have. Tewored the country’s drug bill by about ‘10 per cent. The battle between the generics ‘and originators has been heating up since last summer’s announcement by Montréal-based Ayerst, McKenna and Harrison Inc. that it was moving its basic research operations '— tlie largest of. their kind in Canada — to the U.S. The American multinational’s decision, made partly because of corporate: consolidation as well as federal © licensing laws, will knock more:tham $13 million out of the $75 million a year the industry spends on research, in Canada. It may also cost up to 250 scientists and techniciaiis their jobs. Smith Kline and French Anada Ltd., which closed its basic research facilities right after the current policy took effect, may also close its manufacturing operations. And Merck Frosst Canada Inc., also of Montreal, has shelved plans to expand its drug research because of the uncertainty ” over the licensing laws. The multinationals argue that.as well: as being discrim- inatory, the’ licensing policy costs them tens of millions of dollars a year in lost profits, making it increasingly difficult to persuade their corporate Parents to invest in research and development in Canada. CRITICIZES REGULATIONS _ Gordon F for the P| Manufacturers’ Association of Canada, ue that Canada’ is the one ‘country i eae western world with such patent, protection. With the worldwide costs of developing a new drug running between $50 million and $60 million, no company is willing to gamble on losing its exclusivity on a product it develops in Canada, he says. “The success in the marketplace depends on the development of new drugs, and if a company can't be sure it's going to be able to have a period where it can recover the costs of and make a profit then it simply won't develop them here,” he.says. “The pharmaceutical industry is high-tech and we're losing it.” The multinationals are supported by the money- which depends heavily on research dollars, and officials of federal departments trying to promote economic growth. ‘ STUDIES IMPACT Federal.
