He charges that’they conspired to defraud him of Sgdo by representing _that-Kétt- ner owned the Nordhausen and In- ternational claims in Burnt Basin and would give Dilberger a half- interest in all three claims if the lat- ter would buy the Silver Grey Fox adjoining from Fredrick, as claim was necessary to work the other two. Kettner went to Tacoma and ne- gotiated the deal.and in his evi- dence this morning Dilberger .told how he was first persuaded, by~ the exhibition of fine samples of galena ore, to pay $200 to bind the bar- gain last January.
