In ils ruling, which dismissed the complaint, the board daid it’ did not try to resolve the issue of whether retired workers are employees in the legal sense. Instead it held that it is compatible with the provincial Labor Code for a union acting on behalf of present employees to bargain collectively about the situation of individuals who may not come within the scope of its bargaining unit. In this case, the ruling said, the CPU is entitled to pursue the gubject of pension benefits for retired workers in negotiations and °“to use the normal routes available in the Labor Code to resolve any ‘dispute’ which might arise regarding that issue.” Fr.
