Any person claiming any dam- ages from trespass by any animal im- pounded shall, at any time before the animal is released, deliver to the Pound Keeper a duplicate statement in writ- ing, of his demand against the owner of such animal for trespass, and shall at the same time give his’ written agree- ment under seal, (with a satisfactory surety, if required by the Pound Keep- er), in the form following, or to the like effect :— I (or we) do hereby agree that I (or we) will pay to the owners of the (des- cribed cattle or animals) by me A. Inallcases the Pound Keeper shall within 24 hours, and not before Pounl, the day and hour received by him, redeemed, or sold, the name of the person redeeming, the amount re- ceived for damages, penalties, or fees, or any other information he ma: deem necessary; which return shall veri- fied by statutory declaration if required, and shall be in the form prescribed by the said Police Commissioners. 22, Nothing contained in this by-law ehall be held to prevent the driving of horses, mules, cows. oxen, cattle, sheep, geats, swine, geese, or poultry, through the public streets, provided the eame in sufficient and competent charge, and not allowed to stray, or loiter, or graze, by the way. 28. Nothing herein contained shall be conatrued to entitle the Pound Keeper to retain any fees as his remuneration for duties performed by him under this by-law, but all fees paid to him under the provisions thereof, shall be the property of the City and subject ag to the disposal thereof to resolution of the Council from time to time. PENAL CLAUSE. 24. Any pereon, or the Pound Keeper, guilty of an infraction of this bylaw, upon conviction before the Mayor, Police Magistrate, or any Jus- tice of the Peace, having jurisdiction, shall forfeit and Pay @ penalty, in the discretion of the Mayor, Police Magis- trate or Justice convicting, not exceed- ing the sum of one hundred dollars and costs for each offense, and in default of payment thereof it ehall be lawful for the Mayor, Police Magistrate, or Justice convicting, as aforesaid, to issue a war- rant under his hand and seal to levy the said penalty and costs, or penalty or costs: only, by distress and sale of the _— offender or of- fender’s goods and chattels; and should there be no sufficient distress to satisfy the said penalty and costs, or penalty, or costs only, it shall and may be law- ful for the ‘said Mayor, Police Magis- trate, or Justice 0 convicting, to com- init the offender or offenders to the lock- up house in the said City for any pe ‘iod not exceeding thirty days.
