In British Columbia, for example, a holograph will is d only under ly limited “The only time they are valid is if they were made in a jurisdiction that recognizes them, and even then they only “Bay you've got a fellow who lives in Utah who makes a Utah will that is holographed and he has a bank account up “here and a summer cotta; “If the holograph will is in fact valid in Utah, it will be valid in British Columbia so far as the bank account is - but not so far as the summer cottage.” In such a case, the courts will decide who should get the immovable assets. NEED WITNESSES In Nova Scotia, a handwritten will must be witnessed by at least two adults and signed by the person making the will, says Tim Matthews, another specialist in the field. However, the situation is not as restricted as in British Tourism down in Canada swiss: OTTAWA (CP) — A balmy December might boost the health of the economy as much as it would the spirit of Canadians, and it may be the only thing that now can save the country from suffering a record travel deficit. Figures released recently by Statistics Canada show that during the first three quarters of the year Cana dians spent $1.633 billion more travellilng outside the country than visitors spent travelling in Canada. That's a gap of $75 million more than during the same period last year, when the country was hit with a record travel deficit of $2.2 billion. Whether this year's deficit ends up higher than last year’s may depend on the weather, said Statistics Can ada travel analyst Paul Par adis. An early winter means Canadians could start head. ing south sooner, increasing the amount of money being spent outside the country and pushing this year's de- ficit over last year's record “We're not doing that great,” Paradis said While the weakness of the Canadian dollar against its U.S. counterpart should be luring Americans north, the value of European currencies has been even more de. pressed, making travel there even more attractive. “On top of that, Canadians who could afford it might have chosen to go to Europe as well, because we have an increase of 16.3 per cent in the number of Canadians re- turning from countries other than the U.S.,” Paradis said. The health of the country’s travel account plays a sig nificant role in the balance of payments and whether Can ada comes out ahead or be hind in its financial dealings with the rest of the world. AFFECTS DOLLAR And that in turn affects the value of the dollar, which has been trading at about 76 cents U.S. for the past few months and has been below 80 cents U.S. throughout most of the year. If more money is flowing into the country, than out, it in creases the demand for the dollar and in turn its value. Receipts from visitors ac count for 3.5 per cent of all money earned by the country in the trade of goods and ser- vices, while payments by Canadians travelling outside the country account for 5.5 per cent of all the money spent. The federal government, aware of the importance of attracting visitors to Canada and keeping Canadians at home, earlier.thie year ap. proved a multi-million-dollar television ad campaign de- signed to sell the attraction} of Canadian holidays to bath Americans and Canadians. The latest travel account figures show that during the first nine months of the year $3.668 billion was earned from visitors, up 12.3 per cent from a year earlier, while $5.301 billion was spent outside the country. During the third quarter Canada posted a surplus of $289 million, up from $145 million in the third quarter of 1983. Though a surplus is usual during the third quarter of the year, the increase in the surplus was likely due to the low value of.the Canadian. dollar against its U.S. coun terpart, which seems to have deterred families somewhat from travelling to the United States. Offsetting that to an ex tent were the Olympics and the U.S. election campaign which kept some Americans home during the quarter, Paradis suggested in other jurisdictions it depends on what the law there. there. Prince Edward Island has similar restrictions. How- ever, in both Nova Sotia and Prince Edward Island unwit nessed holograph wills are still recognized in one instance. “They are valid for members of the Armed Forces or seaman of active duty,” Dickson said. “But they could always make holograph wills even when they weren't elsehwere because of the nature of those professions.” And for those professions, on active duty includes a fairly wide range of activities, not just being on the firing line. KEEP SIMPLE Despite the ease of drawing them up, experts say holograph wills — where they are valid — are only suitable for the simpler type of bequeathment. Anything complex that needs to take account of the fact that some people mentioned in the will may already have died needs to be set out in the correct legal manner “Holograph wills are easy to misinterpret,” said Dickson. “People forget that people don't die in the order that you expect them to.
