M. Allan. AN APPEAL FOR CLEMENCY Acting Manager Craig Tells How the Short- Lago Was Discovered and Wherein it Consist- ed—The Bank reoommends Him to Clemency if He Pleads Guilty. : The hearing of Percy M. Allan for defalcations as teller of the Merchants Bank of Halifax was given by Magistrate Boultbee this morning and ended in his conimittal or trial at the county court. As the amount of his shortage has been made good and the directors have authorized an appeal for clemency, on condition that he pleads guilty, he will probably receive’ a light sentence, The only -witness was L. Craig, and acting ger of the bank during the absence of John M. Smith, the manager. He said, under examination by A. H. Mac- Neill, Esq., for the bank, that he had been acting as manager since March 3 and that Allan had been employed as teller since Sept., 1899. In performance of his duty to check the cash kept by Allan, he discov- ered the shortage of $680.20 at the close of banking hours on-March 9, in the presence of Allan, George Leighton and George Fulton. In checking the book, ‘‘specification of cash,” he found an entry. of $750 in- stead of $590 under the heading of defaced ‘notes.. He asked Allan what it meant-and Allan asked him: to wait, saying he would explain afterwards, When he came to count the entries Allan handed him a card, which was put in evidence and on which was written ‘*$627 short. Please do not let the boys know.” Continuing, Mr. Craig saidgje did not count the cash at the time, but put it all away and checked it up in the evening in the presence of “Mr. Leighton, and, he believed, Mr. Fulton. He found silver amounting | to $642.20, while Allan had entered $1,116.40. This entry was false. The shortage was made up‘of $160 short in defaced notes; $474.20 in ‘silver; entries of $35 and $10 for checks carried by Allan, and $1 short in Dominion notes. As ‘to $30 of this, the check was allowed by’him and the $1 Dominion uote was simply an error, leaving a net shortage of $649.20. Under cross-examination by W. J. Nelson Esq:, for the defense,-Mr. Craig said he believed theinformation were correct and they were made under instructions from the head office. He had received a telegram from the head office of which he identified a copy and. this was put in evidence. It read: “Your telegsam today. Provided teller pleads guilty, directors authorize you ask clemency. You may state amount has been made good and give evidence teller's previous satisfactory character. “1D, M. Srewart, tnspector.” He had known Allan since Aug- ust 2, 1899, but Mr. Smith could . give evidence ‘as to his previous good character. He had no per- sonal knowledge of Allan's having taken the money, save that he found from the bcoks that the cash was short and that Allan had charge of it. But for subsequent conversations with Allan, the only evidence was contained in the book. He had been a bank teller for over six years, both receiving and paying. A teller’s books ought to be check- ed three or four times a month. Judge Nelson asked him very particularly whether Allan handed hjm the card admitting the shortage before or after he made the first discovery ‘in regard to it, and he was very positive that this occurred afterwards, . There was some discussion as to bail, but Mr. Boultbee held that he had no authority to accept it, and simply held the ‘accused for trial in the county court.
