Borowski, 47, wants the abortion law declared invalid on the basis that the Cana- dian Bill of Rights protects a human fetus. His lawyer, Morris Shumi- acher, said this week that if Borowski is granted stand- ing, the abortion challenge could go to court in Sas- katchewan next spring. The ruling by Mr. Justice Ronald Martland, supported by six other justices, may lead to further challenges to legislation on the grounds that various laws conflict with the Bill of Rights passed by the Progressive Conser- vative government of the late John Diefenbaker. The Supreme Court, in two major judgments in the 1979s, ruled citizens could the declaratory law while the . censorship law was regula- tory.
