The incorrect wording of the charge in the Criminal Code led to more than an hour of legal debate before the case was adjourned, When court opened Mon- day morning, the charge against the Sutherlands was that they “did commit assault on Van Michael Thutcher and - cause him bodily harm”, hatcher, 26, of Fort Steele, alleges the assault took place June 27 near Winlaw. ° Defence counsé) Michael Moran submitted to Judge R. Submitting that there was “a complete error in the drafting of the charge", Mr. Moran said the charge should be withdrawn and a new charge laid, if that was the wish of the prosecution, Crown counsel Fred An- gene submitted that the infor- mation, as laid, had come out of the Criminal Code and that for the judge to rule the charge null would not be the adminis- tration of justice. Oral Disease Said to be Old As Humans | Study Shows Fossilized remains of man show signs of tooth decay and gum disease dating back to the Stone Age. The most common disorder was excessive wear of teeth, probably the result of chewing coarse foods. There is no evidence of treatment until 700 B.C. and then any advances were kept secret. Rapid adyances are now made through research and science but there are not enough dentists to correct all damage so prevention is impor- tant, There is no single way to prevent tooth decay: but mea-, sures can be taken to reduce it. Tooth brushing removes food particles from the teeth aud that the court had powers to amend the charge. Mr. Moran countered that “nullility cannot be amended”. After hearing the argu- _ment of both counsel, Judge Allan agreed that the charge was incorrectly worded but said “it is my opinion that this charge is one which may be amended.” Judge Allan'then amended the dental plaque.
