Conservative House Leader Ray Hnatyshyn said the bill, amending a section of the Customs Tariff Act that was struck down by a court decision last month, will likely receive royal assent today after it is approved by the Senate. Although opposition MPs said the bill does not go far enough to restrict the importation of violent and child pornography, they agreed to pass it as a temporary measure until more far-reaching legislation can be introduced. The bill will cease to have effect June 30, 1986. Once approved, the amendment will allow customs officers to seize any book, magazine, painting or other material they deem to be obscene or hate propaganda under the Criminal Code. Custom officers previously had the power to confiscate “immoral and indecent” material at the border under a 117-year-old section of the Customs Tariff Act. LAW TOO VAGUE But the Federal Court of Canada, responding to a challenge from a Vancouver man, ruled the section was too vague to be upheld as a reasonable limit on the constitutional right to freedom of expression.
