Vancouver defence lawyer Harry Rankin, Trail defenee lawyer Donald Sperry and Vancouver presecutor Sean Madigan described the brokers either as men who aimed to help the needy, or greed — infected people disregarding the law. The four men, Daniel Voykin, 30, of Brilliant, Steven Evdokimoff, 29, of South Slocan, Samuel Stoopnikoff, 29, of Castlegar and Fred Chursinoff, 50, of Brilliant, are facing charges of fraud and operating a pyramid scheme that netted some $3.2 million in the Koot- enays. The scheme involved investors mak ing a minimum investment of $1,000 cash. Within 60 to 90 days they were to see their money doubled. Once doubled investors then had an opportunity to reinvest. But Reakin, who represents Voykin and Evdokimoff in the trial, insisted the men were duped. “The four were totally naive people,” Rankin told provincial court judge Ron Fabbro, “but so were hundreds of residents of this area. “If you believe, you believe. There is no question they (the brokers) be- lieved,” he said. “When you believe, when a scheme is laid out to you, then it is a scheme that's going to be con: vincing.” 1 Rankin pointed to the simple life style of Powers, the head of the opera. tion and the woman responsible for re- cruiting the four brokers. ’ “Everybody is aware of the Mother Teresas who. would certainly live humbly,” said Rankin. “Their humble- ness is genuine, her humbleness is humbug. “There's no question, looking at it in hindsight, that they (the brokers) were snowed,” he said. “They were com- pletely fooled by this woman... and the snowing went on until the last in- stance,” Madigan said two points should be examined before deciding if the men are guilty: Did they continue to take “investments” even after a simultan- eous police raid of the residences of all four brokers on April 14, 196: and were they aware that’ the “payout” money was actually coming from money collected by the brokers and not by the supposedly generous rich and famous celebrities in the U.S: that Powers claimed were the financial source for the scheme. ‘ “As long as you know that the money collected is going to be used in the payouts, that is the essence,” he said. Madigan said an undercover RCMP officer, operating under a false name, invested money with Stoopnikoff. Valerie Semenoff, 2509 - 10th Ave., filed the suit May 14 in B.C. Supreme Court on behalf of her 29-year-old husband, Gordon, who lies in a coma in the intensiye care unit of St. Paul's Hospital one year after undergoing an operation. The suit alleges that during that operation, Semenoff's heart stopped beating for 14 minutes and as a result he suffered irreversible brain damage The suit is filed against Dr. P.J Kokan, a Vancouver orthopedic sur geon, Dr. Robert L.D. Adams, a Van couver anestheologist, Dr. Patrick J Murray, a Vancouver neurosurgeon and St. Paul's Hospital. No amount of damages is specified. In April 1986, Gordon Semenoff met with Kokan in Vancouver to discuss a back pain Semenoff was experiencing. The suit claims that after examining Semenoff, Kokan diagnosed that the pain was a result of a herniated disc or @ narrowing of the spine and told Semenoff that the pain could be cured either by injection of a chemical into the spine or by surgery. The chem called chymopapain, was injected into Semenoff's spine last May. The suit says a few hours after the injection, while Semenoff was re- covering from the treatment in his hospital room, he began to develop symptoms which consisted of being in “severe pain,” finding it hard to pay attention to people and generally feel ing uncomfortable. Semenoff's legs turned numb and after consulting with Murray, Kokan ordered a CAT scan of Semenoff's spine. Hospital staff failed to examine the proper area of the spine and the CAT scan had to be repeated, the suit says. The suit adds that shortly after the second CAT scan, Semenoff was operated on during which time he suffered a cardiac arrest and the beating of his heart stopped for 14 minutes. Semenoff continues to lie in a coma in his bed at St. Paul's Hospital According to the writ filed May 14% Kokan examined Semenoff last April and told him the risks associated with the chemical injection therapy were less than the risks associated with an operation and that the only risk with the chymopapain injection was the possibility of anaphylytie shock, which is a shock reaction. In addition, the writ claims that Kokan told Semenoff the risks asso ciated with chymopapain injection are low, and if anaphylytic shock did occur that doctors could “easily” correct the problem and that he (Kokan) had never heard of anyone dying or being ser. iously injured by the chymopapain treatment. The writ adds that a CAT scan was performed on Semenoff around April 22, 1986. The writ goes on to say that Semenoff was admitted to hospital on the afternoon of May 20, 1986 under the care of Kokan and that on the same day employees of the hospital provided Semenoff and his wife Valerie written information on the chymopapain treat ment. According to the writ, the Semenoffs discussed the possibility of suffering anaphylytic’ shock but “were reas- sured” by the information supplied by hospital staff. The writ claims that chymophapain therapy was performed on Semenoff on May 21, 1986 by Kokan and Adams. The procedure used in applying hy pain is that the chy fluid is injected from a needle inserted into the patient's back into a disc. The needle is not supposed to pass through the spirial canal, and must not puncture the dura, which is the covering over the spinal cord, and that the chymopapain fluid itself must not enter into the subdural area between the dura and the spinal cord.
