Indeed, the report comes from Waneta that three of Rossland’s iz Armstrong, R. MAGISTRATE’S TROUBLES. He Is Supposed to Have the Patience of Job on Tap. None but the police magistrate knows of the number of people there are here who are totally ignorant regarding the luws which regulate garnishments, labor suits, mortgages, etc. Sometimes he wishes he didn’t know. ‘From early morn to dewy eve,’ in the language of the poet, he is tossed about by the tur- bulent stream of humanity who throng the court-room, besiege his dining place and route him out at night in their frantic eagerness to get even with the other fellow. Probably the most applicants come under the head of the “small debt court.” It is astonishing to contem- plate the number there are of these. The least pretext, from a $1 debt toa 4500 one serves ag an excuse to draw upon the judge’s time. It matters not ther he be plunged deep into an im- portant criminal case with a full court room; whether he be taking an after- noon siesta, or is dining or sleeping, the applicant, in most instances, pounces upon him and demands immediate at- tention. Verily, verily a magistrate’a th in slan: not strewn with roses and if he be not the very monu- ment Of patience the constant irritation and friction would soon wear him into askeleton. ‘Your honor,” eaid an ap- plicant. for justice, rushing into the fourt yesterday while it wasin session, calm your attention for a What | is it?” asked his honor. and so owes me $3 afd refuses to pay it. Then it don’t matter which way his honor decides it is sure to make him an enemy out of one judge. TO PAY HIM FEES Mayor Scott’s Plan of Compen- sating the City Attorney's Services. MR. MACNEILL’S VIEWS Says He Would Rather Get His Money by the Fee System. The suspension of City Solicitor Mac- Neill has stirred up a hornets’ nest in municipal circles, and certain of the aldermen declare they will carry it be- fore the courts and make it a test case. Mr. MacNeill says that he is taking no action in the matter and will do what- ever the council desires. The whole case hinges upon the intrepretation of acertain section of the municipal act, which gives the mayor power to suspend any city officials. After giving notice of the suspension, however, the section states, that the matter must be brought before __ the council at the next sitting, and unless he is reinstated by a majority vote of the council his re-consideration cannot again be brought up before the end of the | term without TURNER IN OITAWA. United States Senator From Washing- ton and Le Roi Owner at Canadas’ Capital. United Sates Senator George Turner was in Ottawa yesterday. No one haa any authority for saying what Senator Turner’s mission was, but it can be surmised without much fear of missing the mark. The senator is a prominent member of the Le Roi Mining company and as such is interested in the new smelter, for which machinery has been ordered, but the site for which has not yet been selected, says the Spokesman- Review. Thereby hangs the visit of Senator Turner to Ottawa. The Le Roi mine ss located in British Columbia, and province is in the Dominion of Ganads, Ottawa is the capital of Canada. When the Le Roi people announced som weeks ago that t ey intended erecting a smelter Rossland was ppy, for Rossland is the town that would So benefited if the smelter was located there, but Mr. Heinze, who ownsa smelter for which heavy cha are made for treatment was ange! But when the matter was under discussion it was shown that to successful a smelter for the low grade ores of Rose land would have to operate chea; than the Heinze smelter, and that tl is could best be done in the United States, and Northport, Wash., was looked upon as a good ‘site. Then’ Mr. Heinze and others raised acry that reached far-off Ouare. it was a cry that Canadian be taken to the nited 8 States for treatment, as if there vas anything new in that, and that the government must protect the wealth oO! the Proving from rapacious the mayor’ consent. arises, however, if the council did not place themselves beyond a re-consider- ation of the matter, by acting upon it the same evenin; the may mayor gave notice of suspension; if by so doing that they ow havea right to bring the matter up ab he next sitting. I really don’t know why my appoint- ment by the council is now o ed b: vhe mayor,” said Mr. MacNeill. ‘True, the mayor has power to suspend city officials and report them at the next sit- sing of the council, and true again there ig nothing in the municipal act that yives the mayor power to remove officials for misconiuct. He dil not allege misconduct to any of iy actions. eve he contended that his desire was reduce municipal expenses. That Object could have been effected in several ways more business-like and were it the wish of the council to re- duce the expenses, the whole matter could have been goon into without any conflict. “The mayor by his sctione) has left me open to the imputation that I have build smel- tere in aie orica they cried, ‘“‘we must put an export duty on crade ore to keep them from treating them.’” Naturally, the threat caused some hesitation in the Le Roi camp. It was their money that developéd ¢! ne Le Roi mine and incidentally it was their mine that built of Rossland. That they were not to be allowed to treat their ores as eheaply as possible was naturally a lit- le strange. But it seemed to the fact, for not long ago the federal govern- ment of Canada empowered itself place a duty on ores. It is no doubt, this emorgency that has called United States Senator Turner to Ottawa, and it will be interesting to learn the results of his visit “T sis Le Roi incident is one of thos things that is likely to to become natic in its importance before it is ende said a British Columbia mine operat living in Spokane. “It would not sui pri. me in the least to see the Le Roi smelter palit at Nortport, and then if t is m: been uilty of misconduct. While Hooson and I were leading him out of the court room he remarked: ‘They didn’t do a thing to me, did they,’ and then he laughed.” It is learned farther from the baer that Wood fought like a tiger when taken. He was accompanied by “aia” McDonald, and armed with a revolver and rifle which he secured by_breaking into Hall’s siding. When-McKinnon, a im, he sacar e his revolver against Mc- Kinnon’s ribs twice, and once against the side of his head. The gun failed fire and to this fact McKinnon owes his life.
