PULP DISPUTE

LRB hears back
to work request

VANCOUVER (CP) — The British
Columbia Labor Relations Board began
a hearing Saturday on a pulp industry
request for a cease-and-desist order to
force the province's 12,700 unionized
pulp and paper workers back to work.

"The board began the proceeding
Saturday night and has set aside a full
day today for the hearings. If the board
grants the order, it is expected the
order would be filed with the B.C.
Supreme Court on Monday at the
earliest.

Meanwhile, talks between negotia-
tors for management and the two
unions continued} Saturday — with
provincial mediator Clark Gilmour and
his assistant Fred Geddes in atten-
dance — under the shadow of a
provincial government threat to
legislate a settlement in the bitter
dispute.

A news blackout on the negotiations
continued.

The labor board also approved a
request from lawyer Jack Giles,
representing the British Columbia
Attorney General, that the ministry be
given formal standing at the hearing.

14 compatiies of workers at its 20 pulp
and paper mills.

The wnions began their strike April
2, the day the lockout was lifted by the
companies in compliance with the

government's Pulp and Paper Collec
tive Bargaining Assistance Act.

The labor board decided to proceed
with the hearing Saturday night after
rejecting a request from the two pulp
unions to delay the hearings.

The board also gave the attorney
general formal standing at the hearing
after Giles argued that the attorney
general represented the public interest
in the dispute, which Giles said was
having a “devastating effect” on small
communities.

The dispute has cost the industry $8
million a day in lost revenue and the
unions about $2 million in lost wages.
However, some of the industry costs
have been offset by savings in wages
and an estimated $50-a-tonne increase
in the price of pulp.

Union lawyer Gary Culhane said it's
wrong for the government to support
the industry’s request for an order
ending the strike because the industry
has lawyers of its own, and govern-
ment input would only slow the
hearings with what he said would be
political posturing.

Labor Minister Bob McClelland
refused to comment on the Social
Credit government's plans, but chief

claims that the employers were aware
of the details of the government's set-
tlement and were in continued contact
with McClelland.

The 20 pulp companies responded by
asking the B.C. Labor Relations Board
to proceed with a cease-and-desist
application, however, the application
seemed to be pushed to the background
as Gilmour entered the dispute.

The back-to-work legislation, passed
Tuesday but retroactive to March 30,
contains no penalties, but the provin-
cial Labor Code provides for fines up to
$1,000 for each individual and $10,000
for unions who defy the new law.

McClelland has made no comment on
whether the government intends to
implement the Labor Code's penalty
sections, other than a statement
Tuesday after the bill became law that
‘T've said for the last two days that
we're not going to jump in and start
throwing people in jail or something.”

The legislation allows the govern-
ment to impose a new contract, but
such a measure must be approved by
the legislature. A week ago, McClel-
land said that if pulp workers did not
return to work, they would be virtually
‘aukifig thé government fo impose a
contract.

Earlier, Lester angered the unions
by telling reporters that the major
stumbling block to an agreement — the
unions’ insistence on a two-year deal or
a three-year pact with a cost-of-living
clause — had been settled.

Time Air makes bid

Castlegar council is‘expected to give
formal support Tuesday night to a bid
by Time Air Ltd, of Lethbridge, Alta.
to take over flights between Castlegar
and Calgary from Pacific Western Air-
lines.

Officials of Time Air and PWA made
joint presentation to council last week,
and received unofficial support for the
change over.

Time Air president Richard Barton
said in a telephone interview Friday
from Lethbridge that his airline filed
an application this week to the federal
Canadian Transport Commission to as-
sume the run from PWA. Pacific West-
ern is a 40 per cent shareholder in Time
Air.

Barton was in the area with Time Air
marketing representative Dwight Jen-
sen and PWA marketing representa-
tive Steve Bullock.

They also spoke to chambers and

councils in Trail and Nelson, as well as
Castlegar.

Castlegar Chamber of Commerce
president Mike O'Connor said the
chamber will make a decision at a
directors’ meeting Wednesday whe-
ther to support Time Air.

Barton said Time Air has received
support from four of the six groups it
spoke to here.

“I think we will get support,” Barton
said of the other two groups who
haven't yet replied.
