When you have a proper will, the. wealth you’ve worked hard to build during your lifetime will go where you want it to go. Without a will, however, you could be laying the groundwork. for financial disaster. For example, if you don’t havea will, you may assume that your spouse will inherit your entire estate when you die. But that's. not the. case Laws in all provinces automat ically split your assets among your spouse, children, and sometimes even your siblings or parents unless otherwise specified in a will. If you're single, your entire estate could go to your parents. Just as important as having a will is ensuring it is up to date. A will that doesn’t reflect changes in your life or evolv- ing legislation may cause more problems than it solves. Review your will annually, as well as when your circum- stances change significant- ly—with a marriage or divorce, birth of a child, a new business deal, an inheri- tance, or a sudden growth in assets, for example. Where should you go to have a will prepared? Although you can do your own, a lawyer is your best bet. A poorly prepared will—especially one with unclear instructions—can result in legal problems. An estate lawyer can instruct you on the fundamen- tals of estate planning, such as minimizing taxes, as well as prepare your will. If your financial circumstances are complex——for instance, if you have considerable wealth, own a business, or have off- shore assets—you should consider consulting a tax lawyer or accountant before having your will prepared. Before you walk into- your lawyer's office, think about how you want your assets distributed. You may want to -bequeath property to certain people or institutions, such as a cottage to your children, or your book collection to a university. Or you may wish to apportion percentages of the value of your assets— everything to your spouse or a specified percentage to each of your children. Your will should also spec- ify who will take care of your young children if you die. This is an issue worth discussing with friends and relatives before you visit your lawyer. You'll also have to choose an executor, who will act on your behalf to settle your estate. You can appoint a family member or close associate as executor. Or, if you require financial exper- tise, you can appoint a trust company. Last, but certainly not least, once you’ve prepared your will let your beneficia- ries know where it is kept.
